Too soon? As lawyers await the outcome of the Brett Kavanaugh hearings, is it too soon to speculate on what the Supreme Court might review next term? One case might be Dan Kleber’s, a 58-year old veteran GC, who is suing medical technology company CareFusion for their employment ad seeking a Senior Counsel with “3 to 7 years (no more than 7 years) of relevant legal experience.” Kleber claims the ad is discriminatory against candidates over age 40 and The 7th Circuit agreed, holding that the law "protects both outside job applicants and current employees." Now the Court, sitting en banc, will rehear his case. Recent litigation has taken on more hiring practices that can negatively impact older applicants, such as experience caps, in employment ads.

Bedfellows with borders: We reported in an earlier Brief about the U.S. Citizen & Immigration Service’s new policy allowing heightened scrutiny of H-1B visas. The crackdown is boosting the job market for immigration lawyers, as law firms struggle to find immigration lawyers with experience to handle increased demand. Just last week, PwC became the second Big Four firm to announce an alliance with a U.S.-based immigration law firm, following Deloitte UK’s deal with Berry Appleman & Leiden in June.
How to improve your firm’s responsiveness. The CBA’s Law Practice Management & Technology Division put out a great video this week about how to improve your response time to clients. It includes many other tips about workflow, leads, and referrals and is a particularly good listen for small firms and solos.
